Cement Truck Water Tank Explodes, Injures Worker Walking By – Case Result: $600,000 Workers’ Compensation Settlement
In a terrible case of being in the wrong place at the wrong time, our client was walking past a cement truck at a downtown Charleston, SC construction site when a valve on the water tank seated on the truck bed exploded and a metal fragment hit him in the head.
Even though he was wearing a hard hat, he suffered a subdural hematoma, or brain bleed. Attorney Adam Greene handled the workers’ compensation case, arguing that the client had permanent and severe physical brain damage with lasting neurological impact. He now suffers from short term memory loss, psychological harm, vision changes, headaches, and neck pain. The defendants argued our client did not have a brain injury.
The case was mediated and ultimately did not settle when the final offer was $500,000. Through ongoing negotiations, the defendants increased their offer to $600,000 to settle the workers’ compensation case entirely.
A settlement agreement was reached in January 2024. The case was completed in less than two years, with much of the testimony and depositions done in Spanish.
