Attorney Thomas White of Steinberg Law Firm Obtains $3.2 Million on Behalf of Paralyzed Client in Recent South Carolina Workers’ Compensation Case
In July of this year, Charleston personal injury attorney Thomas White of Steinberg Law Firm and Peter David Brown helped secure a settlement award of $3.2 million in a South Carolina workers’ compensation case. The settlement represents a major victory for the injured worker, who was left paralyzed after a workplace accident.
The facts surrounding the accident were tragic. Back in 2018, while at work, the employee attempted to lift a scale used to weigh guests’ outgoing laundry. As the worker lifted the scale with the help of a coworker, he injured his back and spine. The man immediately went to the hospital, where Emergency Room doctors told him that he would need immediate surgery. The procedure did not go well, and the worker was left paralyzed from the waist down as a result.
After the accident, the man filed a South Carolina workers’ compensation claim. These claims are filed against the employer’s workers’ compensation insurance carrier, who is ultimately responsible for resolving the claim. Two issues arose in negotiating the worker’s compensation award. First, the injured worker wanted his wife to provide him with the in-home care that he needed, rather than have a part-time home healthcare worker. Second, the man hoped for medical benefits beyond what the workers’ compensation insurer was willing to provide. As attorney White explained, his client “is 46 and has a lifetime of medical care that he wanted to direct, rather than be directed by the workers’ compensation carrier, who controls everything.”
The $3.2 million settlement allows the injured worker to obtain the care he needs and enables his wife to provide the care. Since the settlement, the injured worker is doing much better. He explained that he is glad the process is over and that he no longer has to deal with the workers’ compensation system.
While the details of the settlement are confidential, according to the agreement between the parties, the total award amount was $3.2 million. This includes $2.35 in special damages, intended to cover the man’s future medical care needs.
