$29 Million Medical Malpractice Verdict Upheld
The parents of a boy that developed cerebral palsy after medical staff failed to diagnosis him with a brain infection shortly after birth have been awarded $29.1 million and will keep the money after a federal appeals court reject the US government’s attempt to appeal the decision. The boy, who was born in 2003, suffered a brain infection which hospital personnel failed to treat for nearly 12 hours, despite showing several symptoms of infection. His parents believe that if doctors did not miss the signs and gave their son antibiotics, he would not have developed cerebral palsy. He is now a spastic quadriplegic.
Since the hospital the boy was born at was funded by the federal government, the medial malpractice lawsuit was filed against the United States. The government argued the case should be thrown out because the statute of limitations had passed by the time the boy’s parents filed the lawsuit.
